Tax rules and deductions may vary based on residency status and DTAA (Double Taxation Avoidance Agreement)
For children
Minors earning a salary (e.g., child actors) will receive Form 16 in their name, provided they have a PAN
Good to know
It is a certificate under Section 203 of the Income Tax Act
Part A is centrally generated from the government TRACES portal
Part B is prepared by the employer using their payroll software
Employers can be fined ₹100 per day for late issuance under Section 272A
You can file your ITR without Form 16 by using your salary slips and Form 26AS, though it is harder
If you changed jobs in a financial year, you will get separate Form 16s from each employer
It is not mandatory for an employer to issue Form 16 if no TDS was deducted, but many do as a good practice
Most banks prefer Form 16 over salary slips for large loans because the data is verified by the tax department
Mistakes that get applications rejected
Name mismatch => Ensure your name matches your PAN card exactly so the employer registers it correctly
Ignoring previous employer => Forgetting to collect Form 16 from an old job when switching companies mid-year, leading to incorrect ITR filing
Not checking Form 26AS => Failing to verify if the TDS in Form 16 actually matches the government tax credit statement
Forgetting to declare investments => If you do not give investment proofs to your employer by January or February, they will deduct higher tax and reflect it in Form 16
Keep it safe
Keep the PDF password protected => Form 16 contains your PAN, salary details, and address, making it a target for identity theft
Do not share on public networks => Avoid downloading or sharing it over public Wi-Fi
Verify before filing => Always cross-check the TDS amounts with Form 26AS before using it to file ITR
Submit safely to banks => When giving a physical copy for a loan, write 'Submitted for personal loan application to Bank Name on Date' across the copy
Beware of phishing => Do not click on random emails offering tax refunds that ask for your Form 16 details
Questions people ask
Can I get Form 16 if no tax was deducted?
Employers are only mandated to issue it if TDS was deducted, but many HR portals let you download a zero-TDS Form 16 anyway.
What if my employer refuses to give Form 16?
You can file a complaint with the assessing officer; employers face a penalty of ₹100 per day for refusing.
How do I file ITR if I lost my Form 16?
You can use your monthly salary slips and download Form 26AS or AIS from the Income Tax portal to find the exact TDS details.
Does Form 16 mean I have filed my taxes?
No, Form 16 only proves your employer paid tax on your behalf. You still must log in and file your ITR yourself.
Can I get a consolidated Form 16 for two jobs?
No, each employer will issue a separate Form 16 for the period you worked for them.
Why does my Form 16 show lower tax than my salary slip?
This usually happens if you submitted investment proofs late or if there is a mismatch; check with your payroll team to reconcile.
Is Form 16 required for a credit card?
Yes, if you are salaried, most banks ask for the latest Form 16 or recent salary slips to approve the card.
When is Form 16 issued?
Employers must legally issue it by June 15th every year for the previous financial year ending in March.
